PETERBOROUGH STANDARD CONDOMINIUM CORPORATION NO. 63
BY-LAW NUMBER 2
STANDARD CONDOMINIUM UNIT DEFINITION
BE IT ENACTED as a By-law of Peterborough Standard Condominium Corporation No. 63 (the "Corporation") as follows:
ARTICLE I DEFINITIONS
All words used herein which are defined in the Condominium Act, 1998, S.O. 1998, c. 19, as amended (the "Act"), the Declaration, and By-laws of the Corporation shall have ascribed to them the meanings as set out in the Act, the Declaration, and the By-laws respectively. In addition to the foregoing, the following definitions shall apply:
"Declaration" shall mean the Declaration of the Corporation registered as Instrument No. PE4709 on June 18, 2004 in the Land Registry Office for the Land Titles division of Peterborough (No. 45).
“Improvements” shall mean, in relation to a Unit,
any part of a Unit, where the part does not constitute a Standard Unit or part of a Standard Unit; or
any repair or modification to a Standard Unit that is done using materials that are higher in quality, as determined in accordance with current construction standards.
"Owner" shall have the meaning given to it in the Declaration.
"Standard Unit" shall have the definition given to it in Article II.
“Unit” shall have the meaning given to it in the Declaration.
ARTICLE II STANDARD UNIT
For the purposes of the Act, including Section 56(1)(h) thereof, for purposes of determining responsibility for insuring the Improvements made to Units and for repairing or maintaining Improvements made to Units in accordance with the provisions of the Declaration, a Standard Unit shall be defined as follows:
Measured vertically, each Standard Unit is bounded by: the backside surface of the drywall sheathing or the unit-side surface of the concrete wall and its vertical production; all perimeter walls and walls dividing one Unit from another Unit, including the vertical extension thereof across any opening; the unfinished interior or unit-side surfaces of the window frames, exterior doors, and doorframes; and the interior unit-side surface of all glass panels therein.
Measured horizontally, each Standard Unit is bounded by the upper surface of the concrete floor slab and the backside surface of the ceiling drywall and the horizontal extension thereof across any opening.
Notwithstanding the boundaries set out in Paragraphs 1 and 2 of this Article II, each Standard Unit shall include any fireplace, chimney flue (being a self-contained flue pipe inside the chimney leading from the Unit), fuse box, all heating and cooling fixtures and duct work, plumbing fixtures and outlets, cables, conduits, lines, and connections which are located within the Unit and which serve that Unit only. Notwithstanding the foregoing, no Unit shall include any space or enclosed reserve for water pipes, drain pipes, gas lines, cable television cables, telephone and electrical cables which are for the use of said fixtures and outlets and which are intended to serve other Units as shown in the Description.
The Standard Unit shall not include the floor joists separating the basement and first floor of the Unit, nor any support posts or bearing walls.
The Standard Unit shall not include features which are part of the Common Elements as identified in the Declaration.
ARTICLE III INSURANCE
Each Owner shall obtain and maintain insurance, including personal liability insurance, sufficient to cover the Owner's risks of liability relating to his, her, or its obligation to repair and maintain Improvements made to the Unit in accordance with the provisions of the Declaration.
ARTICLE IV MISCELLANEOUS
The invalidity of any part of this By-law shall not impair or affect in any manner the validity and enforceability or effect of the balance thereof.
No restriction, condition, obligation, or provision contained in this By-law shall be deemed to have been abrogated or waived by reason of any failure to enforce the same, irrespective of the number of violations or breaches thereof which may occur.
The headings in the body of this By-law form no part thereof but shall be deemed to be inserted for convenience of reference only.
This By-law or any part or parts thereof may be varied, altered, or repealed by a By-law passed in accordance with the provisions of the Act and the Declaration.
The foregoing By-law No. 2 is hereby passed by the Directors and confirmed by the Owners pursuant to the Act.
